ILLINOIS AND COOK COUNTY CRIMINAL APPEALS

Andrew Gable is a criminal appellate lawyer and represents people in Federal and Illinois Criminal Appeals as well as Cook County, Illinois and and federal post-conviction matters.  He has handled cases throughout the State, including Cook County, Will County, and DuPage County.  He is also a member of the 7th Circuit Court of Appeals and the Seventh Circuit Criminal Justice Act Panel.

RECENT CRIMINAL APPEALS

 

  • Reversal for client convicted of armed violence.  Client was sentenced to 20 years in prison.  Court of appeals held that the State improperly  introduced improper other crimes evidence.

•  Reversal for client convicted of aggravated criminal sexual assault resulting ​in bodily harm.  Client had been in prison for over 2 years before the reversal.

  • Reversal on appeal for 18 different child pornography counts, 720 ILCS 5/11-20.1, based on allegations that thousands of videos and images were found in the cache of defendant's computer.  Was able to persuade the Court of Appeals that mere presence in computer cache does not demonstrate knowing possession.
     

  • Reversal of portion of federal firearm sentence on appeal in Seventh Circuit because the judge and not the jury made a critical sentencing decision.
     

  • Drafted Appeal resulting in reversal for physician terminated from Illinois State Medicaid Program based on alleged unverified and substantial Medicaid over payments.
     

  • Member of Drew Peterson criminal appellate team.
     

  • Drafted appeal resulting in vacating of sentence for man convicted of first degree murder and mob action
